Ein aktuell bekannt gewordener US-Gesetzentwurf (H.R. 1981: Protecting Children From Internet Pornographers Act of 2011) sieht eine Verpflichtung für US-amerikanische Internet-Service-Anbieter vor, IP-Adressen für mindestens 18 Monate zu speichern.
Der Wortlaut der Passage im Original lautet:
SEC. 4. RETENTION OF CERTAIN RECORDS BY ELECTRONIC COMMUNICATION SERVICE PROVIDERS.
(a) In General- Section 2703 of title 18, United States Code, is amended by adding at the end the following:
‘(h) Retention of Certain Records- A provider of an electronic communication service or remote computing service shall retain for a period of at least 18 months the temporarily assigned network addresses the service assigns to each account, unless that address is transmitted by radio communication (as defined in section 3 of the Communications Act of 1934).’.
(b) Sense of Congress- It is the sense of Congress that records retained pursuant to section 2703(h) of title 18, United States Code, should be stored securely to protect customer privacy and prevent against breaches of the records.
Vergleiche vertiefend zu der Thematik auch den Beitrag “Internet Privacy May Soon be a Thing of the Past“.
Der Gesetzentwurf befindet sich noch in einem frühen Stadium. Insbesondere fehlen noch die Abstimmungen im US-Repräsentantenhaus sowie im US-Senat.
Allerdings weist die Webseite govtrack.us auf folgenden Umstand hin: “This bill was considered in committee which has recommended it be considered by the House as a whole. Explanation: Although it has been placed on a calendar of business, the order in which legislation is considered and voted on is determined by the majority party leadership. Keep in mind that sometimes the text of one bill is incorporated into another bill, and in those cases the original bill, as it would appear here, would seem to be abandoned.”
